5001: Application of Policies to Students Receiving Full-Time Educational Services from ESU 4 on a Contracted Basis

As an intermediate educational service agency, ESU 4 does not have resident students and is not directly responsible for providing students with special or regular education services. However, ESU 4 does operate programs that allow school districts to contract with it to provide full-time educational services to specific students. These programs include, but are not limited to, The Nebraska Center for the Education of Children who are Blind or Visually Impaired ("NCECBVI") and the ESU 4 Learning Center ("Learning Center"). Students may only attend these programs if their resident school district has contracted with ESU 4 to provide full-time educational services to the student. Parents may not enroll their students into any ESU 4 program directly.

Contracted students remain residents of their home school districts for all legal purposes and remain subject to all applicable rules and policies of the resident school districts. Contracted students are also subject to ESU 4's policies. In the unlikely event that ESU 4's policies conflict with the policies of a student's resident school district, the policies of ESU 4 shall control.
